Terms & Conditions​

By making a payment to Med City Moments, both Med City Moments and the Client agree to the following terms and conditions. This contract constitutes the full agreement between both parties and supersedes any prior verbal or written agreements.

1. Services Covered
This agreement applies to the following services offered by Med City Moments:

Photo Booth (Standard & Glam)

Studio Booth
-
Video Guest Book
-
Flower Wall Rental

2. General Terms
Med City Moments will provide services at the venue specified by the Client. The Client must provide a minimum 10x10 ft space for any service, including the flower wall, studio booth, glam booth, or video guest book.

For any services requiring power (photo booth, glam booth, studio booth, and video guest book), the Client must provide access to a 110V, 5-amp, 3-prong power outlet within 10 feet of the setup location.
If the event is outdoors, the Client is responsible for providing shelter or weather protection (e.g., tent or covered structure). Med City Moments is not liable for service interruptions due to inadequate power, extreme weather, or unsafe conditions at the venue.

Setup will occur 30–60 minutes before the event, and breakdown will take 30–60 minutes after services conclude.

2.1 Limitation of Liability
Med City Moments is not liable for any interruptions to the event or loss of services due to circumstances beyond its control, including but not limited to power outages, weather conditions, equipment failure, or guest behavior.
In no event will Med City Moments’ liability exceed the total fees paid by the Client under this agreement.​

3. Photo & Video Rights
Med City Moments retains the copyright to all photos and videos taken during the event and may use them for promotional or marketing purposes unless the Client provides a written request at least 10 days before the event.

By using the photo booth, guests grant permission for their images to be used for promotional use. Clients may use photos and videos for personal, non-commercial purposes. Commercial use requires written consent.

4. Payment & Fees

A $100 non-refundable retainer is required to secure your booking. The remaining balance is due 14 days before the event.

A $25 per day late fee will apply to overdue payments. If the balance is not paid within 2 days of the event, Med City Moments may cancel the booking.

Accepted payment methods: Cash, Venmo, PayPal, Apple Pay, Zelle, or check (payable to Moony Vuong).

4A. Flower Wall Rental & Damage Deposit

If the Client rents a flower wall rental to their booking, a $100 damage deposit is required in addition to the regular rental fee. This deposit will be refunded within 7 days after the event, provided there is no damage to the flower wall or associated props and materials. The deposit will be returned to the same payment method it was received from.

Damage includes, but is not limited to:

Tears or holes in the flower wall fabric or structure

Missing or significantly damaged flowers or decorations

Stains, spills, or water damage

Any alterations or dismantling of the flower wall by guests

If the cost of repair or replacement exceeds the $100 deposit, the Client will be invoiced for the remaining balance. The Client agrees to take reasonable precautions to prevent misuse or rough handling of the flower wall.​

5. Refunds & Cancellations
If Med City Moments cannot provide a functional photo booth for at least 80% of the agreed service time, a prorated refund or extended service time will be offered. If the printer malfunctions, digital copies will be provided instead.

Rescheduling: Date changes must be requested in writing at least 30 days in advance and are subject to availability. If unavailable, the retainer is forfeited.

Cancellations: Cancellations within 30 days of the event will forfeit all payments. In cases of government restrictions, natural disasters, or health-related emergencies, retainer may be applied to a future event.

6. Event Overtime
Overtime is billed at $150 per hour in full-hour increments. Payment for overtime must be made before services continue.

7. Safety & Equipment Damage
Med City Moments reserves the right to deny access to the photo booth in cases of unsafe behavior or if the booth is deemed to be in a location where it poses a safety risk to guests.
The Client will be responsible for any damage, theft, or loss of equipment caused by the Client’s guests. The Client agrees to reimburse Med City Moments for the repair or replacement costs associated with any damage.

8. Liability & Indemnification
The Client agrees to hold Med City Moments harmless from any claims, damages, or liabilities arising from the event, including injuries to guests, equipment damage, or misuse of the photo booth. The Client accepts full responsibility for the behavior of their guests.

9. Venue Communication
The Client is responsible for communicating with the venue and ensuring Med City Moments has access to setup and breakdown areas.
Med City Moments is not responsible for delays or complications due to lack of venue coordination.

10. Legal Provisions
If any part of this contract is deemed unenforceable, the remaining terms shall remain valid.
Any disputes will be resolved through binding arbitration in Minnesota, under the rules of the American Arbitration Association.

Final Acknowledgment
By making a payment, the Client acknowledges agreement to these terms. A retainer is required to secure services. The remaining balance must be paid no later than 14 days before the event.
